Arbitration and Mediation
Since 2011, Ms. Benz has applied her litigation skills and experience to alternative dispute resolution. Her practice involves dispute resolution for individuals and businesses, including lawyers, educators, and medical professionals. She often works with a team of co-counsel, adding collaborative service to her efficient, creative and personal approach to complex legal problems. She is a member of the American Arbitration Association's Commercial and Consumer Arbitration rosters, as well as its Mediation Panel. In December 2013, she was inducted into the Illinois Chapter of the National Academy of Distinguished Neutrals. She also serves as an arbitrator in two Cook County court-annexed arbitration programs.
Mary Pat has been appointed to serve as an arbitrator in more than a hundred American Arbitration Association cases. Examples of cases where she served as an arbitrator include claims involving a non-compete term in a contract for the sale of a candy business, breach of a licensing agreement for manufactured containers, breach of fiduciary duty by the CEO of a non-profit national women's organization, breach of contractual duties by members of a joint venture developing chef-branded restaurants, breach of state regulations by a national pharmacy benefits manager, breach of management contracts for a chain of nightclubs, breach of contract in the design of robotics equipment, legal malpractice, insurance coverage, common law and consumer fraud, defamation, sales representative contracts, UCC issues, personal injury, attorneys’ fees and other professional fees, and professional service contracts.
Mary Pat has served as a mediator and mediation advocate in disputes involving contracts and torts, including legal malpractice, professional fee disputes, business torts and contracts, indemnification of corporate officers and employees, publicity rights, charitable trusts, professional discipline matters involving lawyers and non-lawyers, condominium disputes, and ERISA employee benefit plans.
