Amended Illinois Rule of Professional Conduct
Amended Illinois Rule of Professional Conduct 707 now requires out-of-state attorneys to obtain permissions to represent parties in court-annexed mediations and arbitrations. The rule will limit the number of such proceedings (and court proceedings) in which the out-of-state attorney can appear. It also requires that the out-of-state attorney work with a licensed Illinois attorney, register with ARDC, and pay certain registration fees.
This new rule, effective July 1, 2013, is part of a national trend to regulate the multijurisdictional practice of law and to prevent unauthorized practice. It changes the requirements of Rule 5.5(c)(3) of the Illinois Rules of Professional Conduct for "court-annexed" alternative disupte resolution proceedings.
